Creditor claim in insolvency proceedings
The creditor's claim arose from a contract and a final judgment for JPY 13.4 million plus court costs; enforcement had recovered only part of it. The court reviewed the outstanding balance, converted the foreign-currency obligation into roubles at the Central Bank rate on the date supervision began and deducted amounts already collected. It admitted RUB 7,632,563.97 to the third-priority register.
Defence against subsidiary liability
The bankruptcy trustee first sought RUB 60.98 million in losses and later requested subsidiary liability against the former director and chief accountant, alleging missing inventory, asset transfers and tax violations. The defence challenged the inventory and the evidence linking either person to the loss or the company's insolvency. The court found no proof that the director caused substantial harm or made repayment impossible; tax assessments alone did not establish causation. The trustee stopped pursuing the claim against the accountant, and subsidiary liability was denied.
